RETURNS — CONSUMER’S RIGHT OF WITHDRAWAL

A User who is a consumer has the right to withdraw from a distance sales contract without giving any reason within 14 calendar days from the date on which the User, or a third party designated by the User other than the carrier, receives the Product.

To exercise the right of withdrawal, the User must send Eurosec an unequivocal notice of withdrawal before the expiry of the 14-day withdrawal period. The notice must include sufficient information to identify the User and the relevant order, including the User’s name and order number.

The notice of withdrawal must be sent by e-mail to info@eurosec.eu.

The User may submit the notice of withdrawal in free form or use the statutory model withdrawal form applicable to distance and off-premises contracts.

The User must return the Product without undue delay and no later than 14 calendar days after notifying Eurosec of the decision to withdraw from the sales contract.

The deadline for returning the Product is met if the User sends the Product back before the expiry of the 14-day return period.

The direct costs of returning the Product shall be borne by the User, unless Eurosec has expressly agreed otherwise in writing.

The returned Product should include all items, accessories and documents originally included with the Product.

The User must open the original packaging carefully and avoid unnecessary damage to the Product and its packaging. If the packaging cannot reasonably be opened without damage, the User must use a method that causes the least possible damage.

To establish the nature, characteristics and functioning of the Product, the User may handle and inspect the Product only in the same manner as would normally be permitted in a physical retail store.

The User shall be liable for any decrease in the value of the Product resulting from handling or use beyond what is necessary to establish the nature, characteristics and functioning of the Product.

Damage to the packaging or use of the Product beyond what is necessary does not automatically result in the loss of the right of withdrawal. However, Eurosec may deduct from the refund an amount corresponding to the decrease in the value of the Product caused by such handling or use.

The right of withdrawal does not apply, among other things, to:

  • Products that deteriorate or expire rapidly;

  • Products manufactured according to the User’s specifications or clearly personalised for the User;

  • sealed Products that are not suitable for return for health protection or hygiene reasons if the seal has been opened after delivery;

  • Products that, due to their nature, become inseparably mixed with another item after delivery;

  • sealed audio or video recordings or computer software if the seal has been opened after delivery;

  • digital content not supplied on a tangible medium where performance has begun with the consumer’s prior express consent and acknowledgement that the right of withdrawal will thereby be lost; and

  • other Products or contracts for which the right of withdrawal is excluded under applicable mandatory law.

The right of withdrawal described in this section applies only to a natural person who enters into the sales contract for purposes outside their trade, business, craft or profession. It does not apply to orders placed by companies, public authorities or natural persons acting in the course of their economic or professional activities.

If the User validly withdraws from the sales contract, Eurosec shall reimburse all payments received from the User in connection with the returned Product, including the cost of Eurosec’s least expensive standard delivery method offered for the order.

If the User selected a delivery method that was more expensive than Eurosec’s least expensive standard delivery method, Eurosec is not required to reimburse the additional delivery cost.

Eurosec shall make the reimbursement without undue delay and no later than 14 calendar days after receiving the User’s notice of withdrawal.

Eurosec may withhold the reimbursement until Eurosec has received the returned Product or until the User has provided evidence that the Product has been sent back, whichever occurs first.

Unless otherwise agreed, Eurosec shall make the reimbursement using the same payment method that the User used for the original transaction. The User shall not incur any fees as a result of the reimbursement.

If reimbursement to the original payment method is not possible, Eurosec may request the User’s bank account details.

At the User’s request and subject to Eurosec’s agreement, the returned Product may be exchanged for another Product sold by Eurosec. In such a case, the amount paid for the returned Product shall be offset against the price of the replacement Product. Any remaining balance shall be paid by the relevant party.
